United States v. R.K., 717 F.3d 659 (8th Cir. 2013)
The client pleaded guilty to running a marijuana conspiracy and selling stolen diamonds. At sentencing, the judge imposed a $500,000 fine, despite evidence that the client had no ability to pay such an enormous fine. I and Robert Christensen appealed the fine to the Eighth Circuit Court of Appeals, which agreed that the fine should never have been imposed. The fine was erased, and our client no longer has to worry about how he will ever pay off $500,000.
